    Nav Auto1 is not responsible for the availability of parts or delays in part shipments beyond their control, nor for the loss or damage to the vehicle or articles left in the vehicle in case of re-theft or any cause beyond our control. I do hereby appoint Nav Auto1 to accept on my behalf any and all checks, drafts, or bills of exchange, and endorse all such checks, drafts, or bills of exchange for deposit to the Nav Auto1, account for credit on my account for repairs on my vehicle, which has been released and accepted.

  • In the event the insurance company inadvertently mails the check or settlement supplement check to the customer in error, the customer hereby agrees to notify the said shop immediately, and the customer agrees to deliver such check to the repair facility within 48 hours of receipt of such check. The customer also agrees the Power of Attorney is for the sole purpose of signing o on the original payments or any additional insurance checks or drafts owed on their behalf on said vehicle claim and VIN number.

  • Repair Authorization

    Customer may request an estimate, either written or oral, either of which is binding under Colorado law. Any subsequent written or oral estimates and authorization(s) are legal and binding. The customer authorizes Nav Auto1 to perform the repairs mentioned above and furnish applicable parts and labor. The customer understands any costs quoted heretofore are an estimate only. Nav Auto1 employees may operate the customer’s vehicle for inspection and testing purposes at the customer’s risk. Nav Auto1 will not be responsible for either loss or damage to the customer’s vehicle or any chattels left in the customer’s vehicle. The customer has 72 hours from when the repairs are completed to remove the customer’s vehicle from the Nav Auto1 premises. After that, a storage fee of $100.00 per day will be charged to the customer (excluding Saturdays, Sundays, legal holidays). The customer agrees that Nav Auto1 has an express mechanic’s lien on the above-described vehicle for the charges for parts and labor furnished under this Repair Authorization Form, including those from any prior repair order on this vehicle. If the customer fails to pay such charges, the customer agrees that in addition to the amounts owed under this Repair Authorization form, the customer shall pay the costs of collection and reasonable attorney fees.

    Auto Body & Paint

    Our Warranty covers material and labor to correct any defect in workmanship arising from repairs performed under the original repair order.

    In Addition: Nav Auto1, provides a LIFETIME LIMITED WARRANTY on paint-related priming and painting work against solvent blistering, peeling, hazing, and excessive loss of pigmentation. Defects in parts and materials will be subject to the terms as extended by the manufacturer. SPECIFICALLY EXCLUDED are incidental costs, such as towing fees, car rental charges, travel expenses, per diem expenses, claims of nature, and assemblies and components which are not specially covered by this LIMITED LIFETIME WARRANTY, nor are consequential damages such as damage to other assemblies and components resulting from a defective part or installation of such part installed or repaired during the repair included in this LIMITED LIFETIME WARRANTY. Also, specifically excluded from this LIMITED LIFETIME WARRANTY is paint failure due to pre-existing body rust; scratches, abrasions, or stone chips, whether intentional or accidental; deterioration caused by the use of detergents or waxes not intended for automotive use, acid rain, industrial fallout, or other environmental effects; damages caused by another collision; pain deterioration caused by abuse; failure resulting from product misuse or abuse; custom finishes; exotic finishes; or any refinish procedure other than standard; repairs were done over previously refinished areas unless stripped to bare metal; claims without proper documentation; all solvent blends and single-stage systems. This LIMITED LIFETIME WARRANTY shall not be varied, supplemented, qualified, or interpreted by any prior course of dealings. This LIMITED LIFETIME WARRANTY is for the Customer of Record and Non-transferable.

    Mechanical Waranty

    Nav Auto1 provides no kind of warranty, whether express or implied, when the customer requests used parts to be installed. New parts are warrantied as provided by the manufacturer of the part. Services performed by Nav Auto1, which include the installation of new parts, include a warranty period of 24 months/24,000 miles from the date the services are completed, whichever occurs first. The Nav Auto1 warranty includes nationwide coverage provided by the Technet Professionals (www.technetprofessional.com). The Nav Auto1 Warranty is limited to the services and parts provided and installed by Nav Auto1 and is valid only for the registered owner(s) of the vehicle at the time the repairs were performed. The warranty is nontransferable. Any claim upon the Nav Auto1 warranty must be made by such an owner. This paragraph contains the vehicle owner's exclusive warranty and associated remedy. Accordingly, the vehicle owner or representative by signature below agrees not to pursue any other remedy, including but not limited to disputing any payment made by credit card. The warranties above are exclusive and in lieu of all other warranties, whether express or implied, including the implied warranties of merchantability and fitness for a particular purpose.

    Vehicle (s) deemed total loss.

    Please be advised, and if the vehicle is deemed a total loss by the Customer's insurance company, there will be a $100.00 storage fee per day from the time that the vehicle has arrived at our facility until such time as the insurance company has deemed that vehicle is a total loss. Also, there will be an administration fee of $450.00 dollars and the cost of towing and tear down and inspection that would have occurred. Customer and customer's insurance company is responsible for all related and occurred charges. NO Exception!.

    Arbitration

    The arbitration shall be used to settle any dispute that may arise. The Arbitration shall be held in Denver, Colorado, before a single arbitrator who is knowledgeable in legal procedures, the rules of evidence, and the automotive repair industry. The Arbitration and the selection of the arbitrator shall be conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The Arbitration shall be governed by the laws of Colorado, Including and applicable statutes of limitation and Colorado rules of evidence. The arbitrator shall deliver a written opinion setting forth findings of fact, conclusions of law, and the rationale for the decision. Any opinion entered as a final judgment may be appealed as if it were a judgment of a court of competent jurisdiction. The arbitrator shall have the authority to award legal remedies only, and only to the extent, the same remedies would be available if the parties were before a court of law. The arbitrator shall not have the authority to award punitive damages to either party, to the full extent allowed by law, and in no event shall Nav Auto1 be liable for any indirect, incidental, special, or consequential damages or damages for loss of profit, revenue, or use, incurred by the vehicle owner or any other party, whether in action in contract or in tort, even if advised of the possibility of such damages. Nav Auto1’s liability for damages hereunder shall in no event exceed the amount of fees received by Nav Auto1 for the applicable parts and services that give rise to the liability.

    By signing this, the Customer agrees to all terms and conditions of this contract. Customer represents and warrants that Customer is the owner of the vehicle, or if Customer is not the owner of the vehicle, Customer has the authority to bind the owner(s) of the vehicle to all the terms and conditions of this contract.
